ManageBetter, Inc. ("ManageBetter," "we," "our," or "us") operates the website at managebetter.com and the ManageBetter software platform (collectively, the "Service"). This Privacy Policy describes how we collect, use, disclose, and protect information about you when you use the Service, and your rights and choices with respect to that information.

By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of a business or other legal entity ("Customer"), you represent that you have authority to bind that entity to this Policy, and references to "you" include both you individually and that entity.

1. Scope of This Policy

This Policy applies to all information collected through the Service, including our website, web application, APIs, and any related communications. It does not apply to third-party websites, products, or services that may be linked from our Service, even if they display our branding. We are not responsible for the privacy practices of those third parties.

B2B context. ManageBetter is a business-to-business platform. Our direct customers are companies and their authorized administrators. Individual end users (e.g., managers and employees whose data is processed through the platform) are subject to the privacy practices of the Customer company that deployed ManageBetter, as well as this Policy.

2. Information We Collect

2.1 Information You Provide to Us

  • Account & registration data: Name, work email address, job title, company name, billing address, and payment information when you register for or purchase the Service.
  • Platform content: Performance review text, feedback entries, goal and achievement records, notes, comments, and any other content you input into the Service ("Customer Data").
  • Communications: Information you send us via email, support tickets, surveys, demo requests, or other correspondence.
  • Employee and team data: Information about the employees and team members that Customer administrators add to the platform, including names, roles, reporting relationships, and performance records.

2.2 Information Collected Automatically

  • Log and usage data: IP address, browser type and version, operating system, referring URLs, pages visited, time spent, clicks, and other activity within the Service.
  • Device data: Hardware model, unique device identifiers, and mobile network information where applicable.
  • Cookies and similar technologies: We use cookies, pixel tags, and similar tracking technologies to operate the Service, remember your preferences, analyze trends, and deliver targeted advertising. See Section 8 for details.

2.3 Information from Third Parties

We may receive information about you from third-party services you connect to ManageBetter (e.g., HRIS integrations, SSO providers, calendar tools), as well as from analytics partners, advertising networks, and publicly available sources. We may combine this with information we already hold about you.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and improve the Service: Delivering core platform functionality, generating AI-assisted performance reviews and feedback, processing payments, and enhancing product features.
  • AI model training and improvement: We may use aggregated, de-identified, or anonymized data derived from Customer Data to train, fine-tune, and improve our AI and machine learning models. We will not use identifiable personal information for model training without your explicit consent, except where permitted by applicable law or your agreement with us.
  • Product analytics: Understanding how customers and users interact with the Service to identify bugs, improve UX, and develop new features.
  • Communications: Sending transactional emails (account confirmations, invoices, security alerts), product updates, and — where you have opted in — marketing communications and newsletters.
  • Customer support: Responding to inquiries, resolving disputes, and troubleshooting.
  • Legal and compliance: Complying with applicable laws, regulations, and legal process; enforcing our Terms of Service; protecting our rights, property, and users; and detecting and preventing fraud or abuse.
  • Business transfers: In connection with a merger, acquisition, financing, or sale of all or a portion of our assets.

4. AI-Generated Content and Data Processing

ManageBetter's core functionality involves using artificial intelligence to process Customer Data — including employee performance notes, feedback, goals, and role information — to generate performance review drafts, coaching suggestions, and analytical insights.

You retain ownership of Customer Data. ManageBetter does not claim ownership of content you or your employees submit. However, by submitting Customer Data, you grant ManageBetter a worldwide, non-exclusive, royalty-free license to use, process, store, and display that data solely to provide and improve the Service.

AI outputs are not professional advice. AI-generated content is provided for informational and productivity purposes only and does not constitute legal, HR, employment, or professional advice. Customers are solely responsible for reviewing, editing, and making decisions based on AI-generated outputs.

De-identified aggregate data. We may analyze usage patterns and outputs in aggregate, de-identified form to improve our models, generate benchmarks, and publish industry insights. Such aggregated data does not identify individual users or companies.

5. Disclosure of Information

We do not sell your personal information. We may share your information as follows:

  • Service providers: With trusted third-party vendors who assist us in operating the Service (e.g., cloud hosting, payment processors, analytics tools, AI infrastructure providers), under confidentiality obligations and only to the extent necessary to provide those services.
  • Business partners & integrations: If you choose to connect third-party tools (e.g., BambooHR, Slack, Google Workspace), information may be shared with those services pursuant to their own privacy policies.
  • Legal requirements: When required by law, court order, subpoena, or other legal process, or when we believe disclosure is necessary to protect the safety, rights, or property of ManageBetter, our users, or the public.
  • Business transactions: In connection with a merger, acquisition, bankruptcy, or sale of assets, in which case your information may be transferred to the acquiring entity, subject to reasonable confidentiality obligations.
  • With your consent: For any other purpose with your explicit consent.

6. Data Retention

We retain personal information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Customer Data is retained for the duration of the Customer's subscription and for a reasonable period thereafter (typically 90 days) to allow for data export, unless a longer retention period is required by law or agreed upon in writing. You may request deletion of your data per Section 7 below.

Aggregated, de-identified data derived from your usage may be retained indefinitely, as it no longer identifies you.

7. Your Rights and Choices

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your personal data, subject to legal retention obligations and our legitimate business needs.
  • Portability: Where technically feasible, request your data in a structured, machine-readable format.
  • Objection / Restriction: Object to or request restriction of certain processing activities.
  • Opt-out of marketing: Unsubscribe from marketing emails at any time by clicking the unsubscribe link or contacting us at [email protected].

Note for employees of ManageBetter customers: If your employer uses ManageBetter, your employer (as the data controller) is responsible for managing your rights with respect to Customer Data. Please contact your employer's HR or IT department for such requests.

8. Cookies and Tracking Technologies

We use cookies and similar technologies for:

  • Essential operation: Authentication, session management, and security.
  • Analytics: Understanding usage patterns via tools such as Google Analytics, Mixpanel, or similar.
  • Marketing: Delivering relevant advertising and measuring campaign effectiveness on platforms such as Google Ads and LinkedIn.

You can control cookies through your browser settings or, where available, through our cookie preference center. Disabling certain cookies may impair the functionality of the Service. We honor browser-based Do Not Track signals to the extent required by applicable law.

9. Data Security

We implement industry-standard administrative, technical, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or destruction. These measures include encryption in transit (TLS/SSL), encryption at rest, access controls, and regular security assessments.

However, no security system is impenetrable. We cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your account. Notify us immediately at [email protected] if you suspect unauthorized access.

10. International Data Transfers

ManageBetter is headquartered in the United States. Your information may be transferred to and processed in the United States or other countries where our service providers operate. These countries may have data protection laws that differ from those in your country.

For users in the European Economic Area (EEA), United Kingdom, or Switzerland, we rely on appropriate legal mechanisms for cross-border data transfers, including Standard Contractual Clauses (SCCs) as required under GDPR. By using the Service, you acknowledge and consent to such transfers.

11. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the CPRA, including the right to know, delete, correct, and opt out of the sale or sharing of personal information. As a B2B company, many CCPA rights may not apply to business contact information. However, to the extent they do, you may submit requests to [email protected]. We do not discriminate against you for exercising these rights.

12. Children's Privacy

The Service is designed for business use and is not directed to children under the age of 16. We do not knowingly collect personal information from anyone under 16. 13. Changes to This Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes, we will notify you by posting the updated Policy on this page with a new "Last Updated" date and, where appropriate, by sending an email notification to account administrators. Your continued use of the Service after any changes constitutes your acceptance of the updated Policy. We encourage you to review this Policy periodically.
